Bluebird Pilates LLC

Welcome to Bluebird Pilates. These Terms of Service (“Terms”) govern your use of the Bluebird Pilates website and your purchase or use of our Pilates classes, private sessions, class packages, memberships, and related services.

Bluebird Pilates LLC (“Bluebird Pilates,” “we,” “us,” or “our”) is a boutique reformer Pilates studio located in Baker City, Oregon.

By accessing our website, creating an account, booking a class, purchasing a service, or participating in a session, you agree to these Terms and any applicable booking policies, studio rules, and client consent forms. If you do not agree to these Terms, please do not use our website or services.

1. Our Services

Bluebird Pilates offers instructor-led group reformer Pilates classes, private Pilates sessions, class packages, memberships or other service plans as offered, and related retail products and wellness experiences.

Our services are intended to support movement, strength, mobility, balance, and general physical well-being. Class formats, schedules, instructors, equipment, and service offerings may change from time to time.

We reserve the right to modify schedules, substitute instructors, adjust class formats, or discontinue services when reasonably necessary. When possible, we will communicate material changes to affected clients.

2. Booking and Account Information

Clients may book classes and purchase services through our website or designated booking platform.

When creating an account or making a reservation, you agree to provide accurate, current, and complete information and to update it when necessary. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Reservations are subject to availability. A booking is confirmed when you receive confirmation through our booking system or another designated communication method.

Please review your reservation details carefully before completing a purchase.

3. Payments, Pricing, and Packages

All prices will be displayed or communicated before purchase. Applicable taxes and additional fees, if any, will be disclosed where required.

Payment is due at the time of booking or purchase unless other arrangements have been expressly agreed upon.

Class packages, introductory offers, memberships, gift cards, and promotional offers may be subject to additional terms, including expiration dates, usage limits, eligibility requirements, or restrictions on combining offers. Any applicable restrictions will be communicated at the time of purchase.

Unless otherwise stated in the applicable offer terms or required by law, purchased class packages and promotional offers are nontransferable and are not redeemable for cash.

Refunds, credits, and adjustments will be handled according to the applicable purchase terms and governing law. Nothing in these Terms is intended to waive any refund or cancellation right provided by applicable law.

4. Class Cancellation and Late Arrivals

We understand that schedules change. To provide a consistent experience for all clients, Bluebird Pilates maintains a class cancellation policy.

Our standard cancellation policy is as follows:

  • Advance cancellation: Please cancel your reservation at least 12 hours before the scheduled class to avoid a late-cancellation charge or loss of class credit.

  • Late cancellation: Cancellations made within 8 hours of the scheduled class may result in forfeiture of the class credit or a fee disclosed at the time of booking.

  • No-shows: Clients who do not attend a reserved class and do not cancel may forfeit their class credit or incur a fee.

  • Late arrivals: For safety and to avoid disrupting the class, clients who arrive after the class has begun may be unable to participate. Any applicable class-credit or fee consequences will follow the disclosed booking policy.

Please cancel through the booking platform whenever possible.

If Bluebird Pilates cancels a class or private session, affected clients will be offered an appropriate refund, account credit, or rescheduling option, as applicable and permitted by law.

Any cancellation charges or restrictions will be disclosed before you complete the relevant booking or purchase.

5. Studio Etiquette and Participation

To help create a welcoming, safe, and respectful environment, all clients agree to:

  • Arrive on time and follow instructor guidance.

  • Follow studio rules and equipment-use instructions.

  • Wear appropriate clothing and required grip socks.

  • Treat instructors, fellow clients, and studio property with respect.

  • Notify the instructor of relevant physical limitations or concerns that may affect safe participation.

  • Use reformers and other equipment only as instructed.

  • Refrain from behavior that is disruptive, threatening, discriminatory, or unsafe.

Bluebird Pilates reserves the right to decline participation or ask a client to leave a session when conduct creates a safety concern, materially disrupts the class, or violates studio policies. Any related fees or credits will be handled consistently with the disclosed policies and applicable law.

Please do not attend class if you are experiencing a contagious illness or otherwise believe you may put yourself or other participants at risk.

6. Health, Safety, and Assumption of Risk

Pilates is a form of physical exercise. Participation may involve physical exertion, the use of resistance springs and moving equipment, balance challenges, and movements that may carry a risk of injury.

By participating, you acknowledge that physical activity involves inherent risks, including muscle soreness, strains, falls, and other injuries. You voluntarily accept the ordinary risks associated with participation, subject to applicable law.

You are responsible for determining whether you are physically able to participate safely and for seeking advice from an appropriate healthcare professional when needed. Please inform your instructor about relevant injuries, limitations, or changes in your condition before class.

You agree to follow all safety instructions, use equipment appropriately, and stop exercising if you experience pain, dizziness, unusual shortness of breath, or other concerning symptoms.

Bluebird Pilates may recommend modifications or decline to provide a particular exercise when it appears inappropriate or unsafe.

These Terms do not replace a separate participant waiver or informed consent document. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

7. Educational Services and Medical Disclaimer

Bluebird Pilates classes and sessions are intended primarily for exercise, movement education, and general wellness.

Although our instruction may incorporate movement knowledge and principles informed by physical therapy, participation in a Pilates class does not, by itself, establish a physical therapy or other healthcare provider relationship.

Unless expressly agreed upon as a separate professional healthcare service, our classes and sessions are not intended to diagnose, treat, or cure medical conditions, and they are not a substitute for individualized medical advice, diagnosis, or treatment.

Results vary between individuals. We do not guarantee specific outcomes relating to strength, flexibility, posture, pain, weight, rehabilitation, or overall fitness.

If you have a medical concern, are recovering from an injury or surgery, are pregnant or postpartum, or have questions about whether a movement is appropriate for you, consult an appropriate healthcare professional before participating.

8. Private Sessions

Private sessions are scheduled individually and may be subject to separate booking, payment, cancellation, and rescheduling terms.

Please communicate relevant goals, concerns, and limitations before your session. Your instructor may adapt exercises based on the information you provide and observations made during the session.

Private sessions are not a guarantee of a particular result. Any healthcare services, if separately offered, will be governed by the applicable professional requirements and agreements.

9. Website Content and Intellectual Property

All original content on the Bluebird Pilates website, including text, photographs, logos, illustrations, branding, graphics, and other materials, is owned by or licensed to Bluebird Pilates LLC unless otherwise indicated.

You may view and use our website for personal, noncommercial purposes. You may not reproduce, distribute, modify, publish, commercially exploit, or otherwise use our protected content without prior written permission, except as permitted by law.

The Bluebird Pilates name, logo, and related brand elements may not be used in a way that suggests an unauthorized affiliation or endorsement.

10. Website Availability and Third-Party Services

We aim to keep our website and booking systems available and accurate, but we do not guarantee uninterrupted or error-free access.

Our website may link to or integrate with third-party platforms, including scheduling, payment processing, social media, or other services. Those services may be subject to their own terms and privacy policies.

Bluebird Pilates is not responsible for the independent policies or operations of third-party services, except to the extent responsibility cannot lawfully be excluded.

We may correct website errors, update content, or temporarily suspend access for maintenance or other operational reasons.

11. Privacy and Communications

Our collection and use of personal information are described in our Privacy Policy.

When you provide contact information, you authorize us to use it as reasonably necessary to administer your account, confirm bookings, process purchases, communicate schedule changes, and provide other service-related notices.

Marketing emails, promotional text messages, and other optional marketing communications will be handled in accordance with applicable law and any consent requirements. You may opt out of marketing communications using the unsubscribe instructions provided or by contacting us.

Opting out of marketing communications will not necessarily stop essential transactional or service-related messages.

12. Disclaimers and Limitation of Liability

To the fullest extent permitted by applicable law, the website and its content are provided on an “as available” basis. We make no guarantee that the website will always be uninterrupted, secure, or free of errors.

Nothing in these Terms is intended to exclude warranties, remedies, or rights that cannot legally be excluded.

To the fullest extent permitted by law, Bluebird Pilates LLC will not be liable for indirect, incidental, special, or consequential damages arising from the use of our website or services, where such limitations are legally enforceable.

Nothing in this section limits liability for gross negligence, intentional misconduct, or other liability that cannot lawfully be limited or excluded.

13. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or expenses arising directly from your unlawful conduct, misuse of our website, or material violation of these Terms.

This provision does not require you to indemnify Bluebird Pilates for our own negligence, willful misconduct, or any other matter for which such an obligation would be prohibited by law.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements.

The updated version will be posted on our website with a revised “Last Updated” date. Changes will apply prospectively unless otherwise permitted by law. Where required, we will provide notice or obtain consent before applying material changes to existing arrangements.

Your continued use of the website after updated Terms are posted constitutes acceptance of those changes only to the extent permitted by applicable law. Separate agreements and mandatory legal rights will continue to apply.

15. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be handled in a court of competent jurisdiction as permitted by applicable law. Nothing in this section limits any rights or remedies available to consumers under applicable law.

16. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

17. Entire Agreement

These Terms, together with any applicable purchase terms, booking policies, studio rules, privacy disclosures, and separately executed agreements, govern the subjects they address.

If a separate written agreement contains specific terms for a particular service or purchase, those specific terms will govern to the extent of any conflict, subject to applicable law.
